When I Become a U. S. Citizen, Will My Daughter Also Become One?


A mother asks:

My daughter and I came to the United States together in 2002. I’m thinking of applying for my U. S. citizenship this year. If I do, does my becoming a U. S. citizen also make my daughter a U. S. citizen? She has an expired green card because we forgot to renew it.

Mr. Lee answers:

If your daughter will be under the age of 18 by the time that you are naturalized, she will automatically become a U. S. citizen as long as she is within your legal and physical custody. The fact that her green card is expired does not invalidate her green card status.
