Reader Has Not Had Biometrics Taken for I-751 Application and is Worried

Wu reader asks:

I have a 2-year conditional green card which is expired on August 30, 2008. In May 2008, I filed I-751 removal of conditional green card and have received the receipt notice. But as of now, I haven’t received biometric notice. My friend said Immigration usually would schedule biometrics appointment in about one a month. At the meanwhile, I called to inquire my case twice and was told they would resend my information to the biometrics center. But I still haven’t heard from them. What should I do?

Dear reader:

U.S.C.I.S. usually sends out notices for taking biometrics within 30 days of receiving an I-751 application to remove the conditional basis of permanent residence. The agency will not continue to process an application to completion without biometrics. You are doing the right thing in inquiring about your case by telephone - presumably with the National Customer Service Center (1-800-375-5283), U.S.C.I.S.'s preferred means of customer contact. I suggest keeping up your communications with the NCSC along with sending communications by letter. Although such intervention would not seem necessary to resolve such a simple biometrics situation, you can if feeling desperate contact your local representative in Congress or engage an attorney to press the agency to give you a biometrics appointment.
